リシリレブンガイドネット(以下「当事業者」といいます)が提供するガイドツアーおよびE-bikeレンタルサービス(以下「本サービス」といいます)をご利用いただくお客様(以下「利用者」といいます)は、本規約に同意したものとみなします。

第1条(適用)

本規約は、当事業者が提供する登山、ハイキング、サイクリング、E-bikeレンタルその他のサービスすべてに適用されます。

また、当ウェブサイト上の「Before You Book」ページに記載された事項は、本規約の一部を構成するものとし、利用者は予約申込みを行った時点

でこれらの内容に同意したものとみなします。

第2条(予約の成立)

予約は、当事業者が予約内容を確認し、予約確定の連絡を行った時点で成立します。

第3条(料金および支払い)

利用料金は、各サービスページに表示された料金とします。
支払い方法は、クレジットカード決済、銀行振込、現地決済等、当事業者が指定する方法によります。

第4条(キャンセル)

キャンセル料は当ウェブサイトの「Before You Book」ページに記載された内容に従うものとします。利用者は、本サービスの予約申込みを行

った時点で、「Before You Book」ページに記載されたキャンセルポリシーおよび各種注意事項に同意したものとみなします。

悪天候、自然条件、災害、その他ガイドの安全確保に関する判断、その他やむを得ない事情により当事業者が中止を判断した場合、利用料金は

返金いたします。ただし、現地までの交通費、宿泊費等については補償いたしかねます。

第5条(利用制限)

以下の場合、当事業者は利用をお断りし、または成立した予約を解除することがあります。

・健康状態に不安がある場合
・飲酒または薬物の影響下にある場合
・ガイドの指示に従わない場合
・他のお客様に危険または迷惑を及ぼすおそれがある場合

・過去に本規約に違反した事実がある、または反社会的勢力に該当すると判断した場合

第6条(E-bikeレンタル)

利用者は道路交通法その他関係法令を遵守し、安全運転を行うものとします。

利用者の故意または過失(軽過失を含む)による車両、備品の破損、紛失、盗難については、修理費または実費をご負担いただく場合があります。

第三者への転貸は禁止します。

第7条(禁止事項)

・法令違反行為
・危険運転および無謀な行為
・酒気帯び運転
・車両や装備の改造
・ガイドの指示に反する行為
・他の利用者や第三者への迷惑行為

第8条(免責事項)

自然環境下で行われるアクティビティには、転倒、滑落、落石、強風、低体温、野生動物との遭遇等、予測できない危険が伴います。

当事業者は安全管理に努めますが、利用者自身の不注意、自然条件、第三者の行為等による損害について、当事業者に故意または重大な過失がある

場合を除き責任を負いません。

第9条(写真利用)

ツアー中に撮影した写真や動画を、ウェブサイト、SNS、広告、その他の広報目的で使用する場合があります。

掲載を希望されない場合は事前にお申し出ください。

第10条(救助及び緊急対応)

利用者の事故、体調不良その他緊急事態が発生した場合、ガイドは必要と判断される救助要請、医療機関への搬送その他の対応を行うことがあり

ます。これに伴い発生する費用については、利用者本人の負担となる場合があります。利用者は、本サービス(特に登山・ハイキング・サイクリング)に内在する危険性を理解し、万が一の事故、怪我、遭難時の救助費用等に備え、適切な山岳保険、傷害保険、または国内旅行傷害保険(以下

「各種保険」といいます)への加入を強く推奨します。利用者が各種保険に未加入であること、または加入している保険の補償内容が不十分である

ことにより損害や費用が発生した場合、当事業者は一切の責任を負わず、利用者が自己の責任と費用において負担するものとします。当事業者がツ

アー料金に含めて加入する保険がある場合であっても、その補償範囲は当該保険の約款で支払われる限度内に限るものとし、補償額を超える損害や、

救助費用等の補償対象外となる費用については、利用者が自己の責任と費用において負担するものとします。

第11条(準拠法および管轄)

本規約は日本法に準拠し、本サービスに関する紛争については、当事業者所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

当ツアーにお申し込みいただいた時点で、本規約に同意したものとみなします。

1. 登山、ハイキング、サイクリング等のアウトドア活動には、転倒、滑落、落石、悪天候、低体温、野生動物との遭遇などの予測できない危険

(死亡や重傷に至るリスクを含む)危険が伴うことを理解し、自己の責任において参加するものとします。

2. 天候の急変、自然条件の悪化、その他安全管理上の理由によるガイドの判断により、行程変更または中止となる場合があります。

 なお、これによるツアー代金以外の費用(交通費・宿泊費等)の補償はいたしかねます。

3. ガイドの指示に従わない場合または他の参加者に迷惑や危険を及ぼす行為があった場合、参加をお断りまたは途中で中止する場合があります。

 この場合、ツアー料金の返金はいたしません。

4. 体調不良、持病、妊娠中など参加に不安がある場合は、事前に申告してください。また、当日の飲酒などがある場合は参加をお断りします。

5. 必要装備が不足している場合、安全確保のために参加をお断りすることがあります。その場合、当日キャンセル扱いとなり、規定のキャンセル料

 が発生する場合があります。

6. サイクリングおよびE-bike利用時は道路交通法を遵守し、ヘルメット着用を強く推奨します。

​7. 利用者自身の不注意、健康状態、自然条件、第三者の行為等に起因する事故、怪我、携行品の破損・紛失、損害について、当事業者に故意または

 「重過失」に準ずる過失がある場合を除き責任を負いません。当事業者に過失がある場合の賠償責任は、当事業者が加入する保険により支払われる

 補償額を上限とします。ただし、当該保険が適用されない場合には、当事業者の賠償責任の上限は、利用者が支払ったツアー料金の総額とします。

8. 利用者が当事業者または第三者に損害を与えた場合、その責任は利用者自身が負うものとします。

9. ガイドの安全管理上必要な判断について、利用者は異議を申し立てないものとします。

Terms and Conditions

By using the guided tours and E-bike rental services (collectively, the “Services”) provided by Rishiri Rebun Guide Net (hereinafter referred to as

“the Company”), customers (hereinafter referred to as “Users”) are deemed to have agreed to these Terms and Conditions.

Article 1 (Scope of Application)

1. These Terms and Conditions apply to all services provided by the Company, including mountain climbing, hiking, cycling, E-bike rentals, and

any other related services.

2. In addition, the guidelines and information described on the “Before You Book” page of this website form an integral part of these Terms and Conditions. By making a reservation or placing an order for services, Users are deemed to have agreed to all the contents stated therein.

Article 2 (Formation of Reservation)

A reservation shall be deemed officially confirmed and effective when the Company verifies the booking details and sends a reservation confirmation to the User.

Article 3 (Fees and Payment)

1. Service fees shall be as displayed on the respective service pages of this website.

2. Payment must be made through methods designated by the Company, which may include credit cards, bank transfers, or on-site payment.

Article 4 (Cancellation and Refunds)

1. Cancellation fees shall be governed by the policies described on the “Before You Book” page of this website. By making a reservation, Users

are deemed to have agreed to the cancellation policy and all applicable notices stated on that page.

2. If the Company decides to cancel the Services due to adverse weather, natural conditions, natural disasters, the guide's safety judgement, or

any other unavoidable circumstances, the service fees paid by the User shall be refunded in full.

3. However, the Company shall not be liable or responsible for compensating any other expenses incurred by the User, including but not limited

to transportation fees and accommodation costs.

Article 5 (Restrictions on Use and Termination)

The Company reserves the right to refuse participation or terminate an existing reservation without any liability if a User falls under any of the following conditions:

- The User's health or physical condition raises safety concerns;

- The User is under the influence of alcohol, drugs, or other controlled substances;

- The User fails to follow the instructions or directions of the guide;

- The User acts in a manner that may endanger, disrupt, or cause a nuisance to other participants;

- The User has previously violated these Terms and Conditions, or is determined by the Company to be associated with organized crime groups, anti-social forces or illicit activities.

Article 6 (E-bike Rentals)

1. Users shall strictly comply with the Road Traffic Act and all other applicable laws and regulations, and shall operate E-bikes in a safe and responsible manner.

2. In the event of damage, loss, or theft of the vehicles or equipment caused intentionally or through negligence (including minor negligence)

by the User, the User may be required to bear the full cost of repairs or actual replacement expenses.

3. Subleasing, lending, or transferring rented E-bikes and equipment to any third party is strictly prohibited.

Article 7 (Prohibited Acts)

Users are strictly prohibited from engaging in any of the following acts during the use of the Services:

- Violating any applicable laws, ordinances, or regulations;

- Dangerous driving, reckless behavior, or operating the vehicle in an unsafe manner;

- Operating any vehicle under the influence of alcohol (drunk driving or riding);

- Modifying, altering, or tampering with the vehicles, accessories, or equipment;

- Refusing to follow or acting in defiance of the guide’s instructions or directions;

- Causing trouble, harassment, disturbance, or danger to other users, participants, or third parties.

Article 8 (Disclaimer and Limitation of Liability)

1. Users acknowledge that outdoor activities conducted in natural environments inherently involve unpredictable and unavoidable risks,

including but not limited to falls, slips, rockfalls, strong winds, hypothermia, and encounters with wildlife.

2. While the Company makes every reasonable effort to manage safety, it shall not be held liable or responsible for any injuries, damages, or

losses arising from the User’s own negligence, adverse natural conditions, or the actions of third parties, except in cases of willful misconduct or gross negligence on the part of the Company.

Article 9 (Use of Photographs and Videos)

1. The Company may use photographs, videos, or other visual media captured during the Services for its website, social media channels, advertisements, and other promotional or marketing purposes.

2. If a User does not wish to have their image or media published, they must notify the Company in advance.

Article 10 (Rescue and Emergency Response)

1. In the event of an accident, illness, or other emergency involving a User, the guide may, at their discretion, arrange for rescue services, transportation to medical facilities, or any other necessary emergency measures. Any and all costs arising from such measures may be borne

by the User.

2. Users acknowledge and understand the inherent risks associated with the Services, particularly mountain climbing, hiking, and cycling. Users

are strongly encouraged to obtain appropriate mountain rescue insurance, accident insurance, or domestic travel insurance (collectively, “Insurance”) prior to participating.

3. If damages, losses, or expenses arise due to the User’s failure to maintain adequate Insurance coverage, the Company shall bear no responsibility or liability, and such costs shall be borne solely by the User at their own risk and expense.

4. Even if the Company provides insurance coverage included within the tour or service fees, any compensation shall be strictly limited to the scope and amount payable under the specific terms and conditions of that insurance policy. Any damages, rescue costs, or other expenses exceeding such coverage or excluded from the policy shall be the sole responsibility of the User. 

Article 11 (Governing Law and Jurisdiction)

1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.

2. Any disputes, controversies, or claims arising out of or in connection with the Services or these Terms and Conditions shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company's principal place of business as the court of first instance.

By booking or participating in our tours, you acknowledge and agree to the following terms and conditions:

1. Assumption of Risk

You understand that outdoor activities such as mountain climbing, hiking, and cycling involve inherent and unpredictable risks, including but

not limited to falls, slips, rockfall, severe weather, hypothermia, and encounters with wildlife, which may result in serious injury or death. You voluntarily participate in these activities at your own risk and expense.

2. Changes or Cancellation Due to Safety Considerations

Tour itineraries may be modified or canceled at the guide’s discretion due to sudden weather changes, deteriorating natural conditions, or other safety-related reasons. In such cases, the Company shall not be liable for any incidental expenses or costs other than the tour fee, including but not limited to transportation costs and accommodation expenses.

3. Compliance with Guide Instructions
Participants must follow the instructions and decisions of the guide at all times. The Company reserves the right to refuse participation or terminate a tour without refund if a participant fails to follow the guide’s instructions or engages in conduct that may endanger or disturb other participants.

4. Health Conditions and Alcohol Consumption
Participants must disclose to the Company in advance any pre-existing medical conditions, illnesses, injuries, pregnancy, or any other physical conditions that may affect safe participation. Participants who are under the influence of alcohol or otherwise deemed unfit to participate may

be refused participation or removed from the tour without refund.

5. Required Equipment

Participants are solely responsible for bringing the required equipment and clothing. If a participant lacks the necessary equipment for safe participation, the Company reserves the right to refuse participation for safety reasons. In such cases, the cancellation shall be treated as a

same-day cancellation, and the applicable cancellation fees may apply.

6. Cycling and E-bike Use

Participants shall strictly comply with the Road Traffic Act and all other applicable traffic laws and regulations while cycling or using E-bikes.

The wearing of a safety helmet is strongly recommended while cycling or using E-bikes.

7. Disclaimer and Limitation of Liability

Except in cases of willful misconduct or gross negligence on the part of the Company, the Company shall not be held liable for any accidents, injuries, illnesses, damage to or loss of personal belongings, or any other losses arising from the participant's own negligence, health conditions, natural conditions, or the actions of third parties.

Where the Company is found liable, the Company's liability shall in not exceed the amount payable under the Company's insurance policies.

In the event that no insurance coverage applies, the Company's liability shall be limited to the total amount of the tour fees actually paid by

the participant.

8. Liability for Damages Caused by Participants

Participants shall be solely responsible for any damage, injury, or loss caused to the Company, its staff, or any third party as a result of their

actions and shall bear all associated costs and liabilities at their own expense.

9. Guide's Safety Decisions

Participants agree that all decisions made by the guide for safety and operational reasons shall be final and binding and shall not be subject to objection or dispute.
